Terms of Service - Mentor Park

Welcome to Mentor Park! These Terms of Service (“Terms”) govern your use of our platform and services. By accessing or using Mentor Park, you agree to comply with these Terms. If you do not agree, please do not use our platform.

1. Acceptance of Terms

By registering for, accessing, or using Mentor Park, you agree to be bound by these Terms and our Privacy Policy. Mentor Park reserves the right to update or modify these Terms at any time. For material changes, we will provide notification via email and/or platform alerts at least 30 days prior to implementation. Continued use of the platform after such notice constitutes acceptance of any changes.

2. Eligibility

To use Mentor Park, you must:

Be at least 18 years old or have parental/guardian consent.
Provide accurate and complete registration information.
Not have been previously banned from Mentor Park.
Comply with any verification processes for professional credentials if required for certain mentorship categories.
Understand that services may not be available in all regions or jurisdictions.

3. Platform Services

Mentor Park connects mentors and mentees for professional and personal development. We do not guarantee outcomes from mentorship and are not responsible for interactions between users. Mentor Park does not independently verify all credentials or qualifications of mentors but provides tools for community rating and feedback. A “mentorship session” refers to any scheduled interaction between mentor and mentee facilitated through our platform.

4. User Responsibilities

As a user of Mentor Park, you agree to:

Conduct yourself professionally and respectfully.
Provide truthful and accurate information.
Comply with our Code of Conduct (available at mentorpark.com/code-of-conduct).
Maintain appropriate confidentiality of information shared during mentorship sessions.
Not engage in fraudulent, misleading, or harmful activities.
Not use AI-generated responses in mentorship interactions without disclosure.
Not impersonate others or create fake profiles.
Not post or share content that is illegal, harassing, discriminatory, obscene, or infringing on others’ rights.

5. Payments & Refunds

Mentor Park charges fees for mentorship sessions and premium platform features.
All payments are processed in US Dollars through our third-party payment processors.
Payments are due at the time of booking a session unless otherwise specified.
Cancellations made more than 24 hours before a scheduled session are eligible for a full refund.
Cancellations made within 24 hours of a scheduled session are eligible for a 50% refund.
Refunds for completed sessions will be reviewed and issued on a case by case basis.
Mentor Park reserves the right to issue refunds at its discretion for service disruptions or quality concerns.

6. Intellectual Property

All content on Mentor Park (except user-generated content) is owned by or licensed to Mentor Park.
Users retain ownership of their content but grant Mentor Park a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display content shared on the platform for the purposes of operating and promoting the service, including for commercial purposes.
This license continues even after account termination for content that was shared publicly on the platform.
You may not copy, modify, or distribute any part of Mentor Park’s intellectual property without written permission.

7. User-Generated Content

You are responsible for content you share, ensuring it does not violate laws or third-party rights.
Mentor Park reserves the right to remove any content deemed inappropriate without prior notice.
Prohibited content includes but is not limited to: copyright-infringing material, hate speech, explicit sexual content, threats, spam, malware, and content promoting illegal activities.
To report copyright infringement, please contact our DMCA agent at support@mentorpark.com with details of the alleged infringement.

8. Termination

We may suspend or terminate your account if you violate these Terms, engage in misconduct, or act in a way that harms the platform or its users.
Users may deactivate their accounts at any time through account settings.
Upon termination, your profile and future access will be disabled, but your previous contributions may remain visible to users with whom you’ve interacted.
We retain user data after termination as required by law and outlined in our Privacy Policy.
Users whose accounts have been terminated may appeal by contacting support@mentorpark.com within 14 days of termination.

9. Disclaimers & Limitation of Liability

Mentor Park provides mentorship services “as is” without warranties of any kind, either express or implied.
We do not guarantee the qualifications, expertise, or advice quality of any mentor on the platform.
Our liability is limited to the amount of fees paid by you to Mentor Park in the 12 months preceding any claim.
We are not liable for disputes between users or any indirect, incidental, or consequential damages arising from platform use.
Mentor Park is not responsible for the content of external websites linked from our platform.

10. Indemnification

You agree to indemnify, defend, and hold Mentor Park and its officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) resulting from your use of the platform or violation of these Terms. Mentor Park will provide prompt notice of any such claim and allow you to control the defense, subject to Mentor Park’s right to participate at its expense.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
Any dispute arising from these Terms shall first be addressed through informal negotiation for a period of 30 days.
If the dispute remains unresolved, it shall be settled by binding arbitration conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association in Dallas, Texas.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Data Privacy and Security

We collect and process personal data as described in our Privacy Policy.
You consent to our data practices as outlined in the Privacy Policy, including the collection, use, and sharing of your information.
While we implement reasonable security measures, no system is completely secure, and you use our platform at your own risk.

13. Force Majeure

Mentor Park will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, government actions, power failures, and internet or service disruptions.

14. Assignment

Mentor Park may assign these Terms or any rights hereunder without restriction.
Users may not assign or transfer their accounts or rights under these Terms without prior written consent from Mentor Park.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Mentor Park regarding the subject matter hereof and supersede all prior agreements or understandings.

17. Changes to Terms

Mentor Park reserves the right to update these Terms. Users will be notified of significant changes via email and/or platform notifications at least 30 days before implementation.
